Poland's Fine and the Battle Against Amazon stirs up the European Market

Poland's competition and consumer protection watchdog have levied a substantial fine of approximately $8 million (31.9 million Zlotys) against Amazon's European subsidiary for employing deceptive tactics, known as "dark patterns," to manipulate online shoppers. The preliminary ruling, targeting Amazon EU SARL, responsible for managing Amazon's Polish e-commerce platform, Amazon.pl, from Luxembourg, underscores misleading practices concerning product availability, delivery schedules, and drop-off time assurances.

The regulatory decision, subject to appeal, stems from Amazon's recurrent cancellation of customer orders, particularly for e-book readers and other merchandise. Amazon's stance that sales contracts and delivery obligations are only activated post-shipment contradicted customers' expectations, leading to frustration and complaints lodged with the consumer protection authority.

One of the focal points of the regulator's rebuke is Amazon's use of ambiguous language buried within its website interface. Critical information regarding potential order cancellations was obscured, written inconspicuously in gray font against a white background at the bottom of the page. This practice, the watchdog contends, misled customers who reasonably assumed their purchases were secure based on cues like "Buy Now" and "Proceed to Check out," implying a contractual commitment.

Tomasz Chróstny, the agency's chairman, emphasized consumers' entitlement to transparent purchase options and delivery assurances without the need for additional verification steps. He underscored the deceptive nature of Amazon's countdown timers, labeling them as "dark patterns," designed to induce rushed purchases by creating artificial scarcity and urgency.

Amazon's utilization of these tactics, including misleading countdown timers and opaque cancellation policies, was condemned for coercing consumers into hasty decisions, undermining trust in e-commerce transactions. Chróstny emphasized the obligation for traders to uphold delivery commitments and cautioned against deceptive practices under the guise of promotional urgency.

This regulatory scrutiny aligns with similar allegations against Amazon's US operations, where accusations of employing dark patterns to manipulate customer behavior have surfaced. Last year, the US Federal Trade Commission initiated legal action against Amazon, alleging manipulative interface design aimed at auto-renewing Prime memberships without adequate consent.

In response to the fine, Amazon's spokesperson acknowledged occasional delivery discrepancies but asserted ongoing efforts to enhance the customer experience on Amazon.pl. The spokesperson highlighted the company's collaboration with regulatory authorities and voluntary amendments proposed to address consumer concerns. Amazon vehemently contested the regulatory assessment, signaling its intent to appeal the decision while reaffirming compliance with legal standards across its global operations.

Despite the significant fine imposed by Poland's regulatory authority, Amazon's financial standing remains robust, with profits totaling $30.4 billion in 2023. While the fine represents a nominal setback in Amazon's financial landscape, the company's commitment to challenging the regulatory ruling underscores its stance on regulatory compliance and consumer trust.
